In the United States, there are no laws that prevent you from installing a hidden camera in your home since your purpose is to monitor the safety of people living in it. For instance, busy parents decide to keep a hidden camera that can check what is going on when they are away at work. If there is a nanny in the house tasked to take care of your children, it helps ease your worries by having a security camera placed strategically in locations for proper surveillance. 

However, it is advisable that before you have a camera installed, you may need to contact your attorney regarding any laws involving the use of this device, particularly in the state of your residence. Moreover, there is a difference between an audio and video recording. There are states where video recordings are not considered as legal, specifically if these invade a person's privacy. Hence, it is essential to be aware of such laws to prevent any legal concerns along the way.

Hidden Cameras in Public Areas and the Workplace

If the camera is placed in a public place such as a restaurant or retail shop, there are no laws that prevent the installation of such device. It is considered as legal to have this type of camera set up since business owners have a responsiblity towards their properties. The same holds true when it comes to having video recordings in public squares, malls and parks, particularly when the safety of the public is at risk.

When it comes to the workplace such as the office or firm, there are no laws that are established to ban the installation of these hidden cameras. In fact, there are several business owners who decide to invest on security cameras to make sure their employees are performing their tasks as expected. Yet, this type of device is not a primary requirement in businesses, but it is only a matter of choice upon the discretion of the owner.


Devices that record audio files from conversations that transpire in public places are also not considered as illegal. The only concern is that recording a telephone call may involve a certain law since it is required to have the consent of one of the parties during the recording. Some states, however, require two-party consent for audio recordings
